Welcome to BemaPay's free online tools ("the Service"). By accessing or using the Service, you agree to these Terms of Use. If you do not agree, please do not use the Service.
1. Eligibility
The Service is provided for individuals and businesses based in Canada. You must be at least 18 years old or have parental consent to use it. The Service is offered in English and Canadian French (Québec).
2. Free use
The free tools (payroll calculator, employee cost estimator, invoice generator) are offered at no charge. We may, at any time, modify, suspend or discontinue all or part of the Service without prior notice.
3. Account and saved data
Creating an account allows you to save your invoices, your logo and your branding. You are responsible for the confidentiality of your credentials and for all activity performed through your account. Notify us immediately of any unauthorized use.
4. Acceptable use
You agree not to: (a) use the Service for any unlawful, fraudulent or harmful purpose; (b) attempt to interfere with the operation of the Service or its security; (c) use automated tools (scraping, bots) to extract data without our written consent; (d) issue invoices for goods or services that violate Canadian law.
5. Tax & legal accuracy
The calculations provided (CPP, EI, federal and provincial income tax, GST/HST/QST) are based on the rates published by the Canada Revenue Agency (CRA) and Revenu Québec. They are estimates provided for informational purposes only. BemaPay is not a tax advisor. Always verify with a chartered professional accountant (CPA) or with the CRA / Revenu Québec before filing.
6. Intellectual property
The Service, including its source code, design, logo and content, is the exclusive property of BemaPay. You retain ownership of the data you enter (invoices, client list, logo). By using the Service, you grant us a limited licence to host and display this data to provide the Service to you.
7. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that the calculations will be accurate in every situation.
8. Limitation of liability
To the maximum extent permitted by Canadian law (in particular by the Civil Code of Québec and the federal laws of Canada), BemaPay's total liability shall not exceed CAD 100, or the amount you paid to us during the twelve (12) months preceding the event, whichever is greater.
9. Termination
You may delete your account at any time by contacting us. We reserve the right to suspend or terminate any account that violates these Terms.
10. Governing law
These Terms are governed by the laws in force in the Province of Québec and the federal laws of Canada applicable therein. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of the judicial district of Montréal, Québec.
11. Changes
We may update these Terms. The most recent version will always be available on this page with its update date.
